Usage conditions for the Neugart Tec Data Finder


1. User obligations

The user is obliged not to pass the access data which he/she has created (login and password) to third parties, and take measures to rule out direct or indirect use by third parties. The user is liable for any abuse of his/her password and user account, if he/she is responsible for the abuse. The user is personally responsible for obtaining and setting up the technical prerequisites for his/her access and transmission capabilities.

2. Application area

These usage conditions apply to free use of the Online Portal at website: www.neugart.com/en/tdf/.

The Tec Data Finder is a password-protected platform that the provider makes available to its customers. Neugart GmbH is a database product of the provider's in the sense of § 4, Para. 2 of the UrhG (German Copyright Act) or a database in the sense of section 87 a, Para. 1 of the UrhG, and may only be used within the scope of acquired usage rights. The associated computer programs are subject to protection in accordance with sections §§ 69 a et al of the UrhG.

3. Services

The Neugart Tec Data Finder is available to the user within the scope of the technical availability that is possible on the part of the provider. For technical reasons, the provider cannot guarantee continuous availability (e.g. because of routine preventive maintenance and repair work or circumstances for which the provider is not responsible such as defects/failures of the data transmission network, power failures or problems with the user's hardware, industrial action and other Acts of God). Non-availability for technical reasons for which the provider is not responsible or which occur because of routine preventive maintenance and repair work are restrictions which are within the scope of the non-availability that is allowed for the provider.

4. Payment

The provision and use of the Tec Data Finder (TDF) is free of charge to the user.

5. Duration, blockage and end of use

The provider is entitled to block content (e.g. text, images, links) in the user's customer area if it is illegal or if the provider becomes aware of specific indications of the illegality thereof which have not been refuted by the user, but only if and for as long as these indications exist.
